What is the legitimate legal ruling for a wife who separated from her husband due to war and refuge circumstances, and was subjected to harassment and abuse, and her request for divorce was met with rejection by her husband who is married to another?

If a woman is harmed by her husband's prolonged absence, she has the right to bring her case before a Sharia judge to seek a divorce. The Maliki school of thought permits separation after one year of his imprisonment. However, a woman should be patient, virtuous, and fast frequently, while safeguarding her hearing and sight, avoiding places of temptation, occupying her time with beneficial deeds, keeping company with righteous women, and engaging in much remembrance of Allah and supplication.
