Does a man's divorce take effect if he was intoxicated?
Drinking alcohol is a sin and a major transgression forbidden by Allah Almighty and His Messenger, peace and blessings be upon him. As for the two divorces pronounced by the husband, if they occurred together while he was in a state of unconsciousness, then nothing is incumbent upon him. But if they occurred together while he was aware of what he was saying, then the first and second divorces take effect if they were pronounced during the 'iddah (waiting period). Alternatively, only one of the two divorces might be effective if it was pronounced while he was aware of what he was saying. If the marital relationship persists, we advise the wife to gently counsel her husband. If this does not help, she may refer the matter to the Sharia court and request a divorce.
