If the fault lies with another person and they refer you to the insurance company for your right, there is no harm in benefiting from the amount.

However, if you are a participant in an insurance contract, a distinction must be made: If it is a cooperative Takaful insurance: There is no harm in benefiting from what is provided. If it is a prohibited commercial insurance: It is not permissible to benefit from more than what you contributed, and the excess is unlawful wealth that must be disposed of by spending it on Muslim welfare or for the poor and needy.
