Can a piece of land be dedicated as an endowment (waqf) to avoid its future inheritance?

If a man dedicates land or other property as an immediate endowment (waqf munajjaz) while in good health, it passes out of his ownership and does not become part of the inheritance. However, if he makes the endowment conditional upon his death, such as by saying, "This land is an endowment after my death," the endowment is valid according to the preponderant opinion. In this case, it is disbursed from one-third of the estate, and anything exceeding one-third cannot be disbursed without the permission of the adult heirs. If he dedicates it during his death illness (marad al-mawt), it is also disbursed from one-third, and anything exceeding that cannot be disbursed without the permission of the heirs.
