Is it permissible for me to help my client obtain compensation from a commercial insurance company, knowing that Takaful insurance is available, given that his house was damaged and he had insured it with this type of insurance?
Commercial insurance, in all its forms, is forbidden due to its reliance on usury and gambling, except for one who is compelled to it, in which case he is permitted to limit himself to the minimum necessary, and the sin is upon the one who compelled him. As for one who participates voluntarily in commercial insurance, he is only entitled to compensation equal to what he paid, and he must return the excess to the insurance company. If they refuse to accept it, he should donate it to the poor and needy, unless he himself is poor, in which case he may take from it what he needs. If you predominantly believe that your colleague will only take the amount he paid, then it is permissible to assist him. However, if you predominantly believe that he will take more than he paid, then it is not permissible for you to assist him, for Allah Almighty says: ﴿And cooperate in righteousness and piety, but do not cooperate in sin and aggression. And fear Allah; indeed, Allah is severe in penalty.﴾
