If a husband swears to divorce his wife if a certain event occurs, and that event then takes place, her divorce occurs immediately upon the event's occurrence. If this is the first or second divorce, he may take her back as long as she is within her iddah (waiting period). He must be careful not to repeat swearing by divorce, because a third divorce makes her unlawful for him until she marries another husband. This is the view of the majority of jurists. However, Shaykh al-Islam Ibn Taymiyyah and Ibn al-Qayyim held the view that a conditional divorce that has the meaning of an oath does not occur, and an expiation for an oath (kaffarat yameen) becomes obligatory in such a case.
