Is a husband who was unable to deflower his wife, and then cheated on her, considered a muhsan (married person) subject to stoning, or a virgin?

The "ihsan" (chastity) that necessitates stoning in the حد الزنا (punishment for unlawful sexual intercourse) is achieved by the mere disappearance of the glans into the wife's vagina. It does not require complete intercourse; rather, the disappearance of the glans, or its equivalent for one whose glans is amputated, suffices. Whoever falls into indecency must perform sincere repentance and conceal their sin. The implementation of punishments is entrusted to the Muslim ruler.
