What is the ruling on someone who performed Umrah during the months of Hajj with the intention of Tamattu then returned to his country and was unable to perform Hajj? Does he remain in a state of ihram and prohibited from what a pilgrim is prohibited from, and what is the ruling on his Umrah?

Umrah during the months of Hajj is one of the best acts of drawing closer to Allah. If a Muslim performs Umrah during the months of Hajj and then decides not to perform Hajj, there is no blame on him, and he is not required to abstain from what a pilgrim in Hajj abstains from, nor is he required to offer a sacrifice (dam) because he did not perform Hajj in that year. One of the conditions for the obligation of the dam for tamattu is that one must perform Hajj in that year. So, whoever does not enter into ihram for Hajj has not yet combined Umrah with Hajj (tamattu), and there is no hady (sacrifice) upon him if he does not perform Hajj in that year. The dam for tamattu is also waived for one who performs Umrah and then returns to his country.
