The deceased has two situations: Either he endowed or bequeathed money for the poor and the needy, in which case it is permissible to give some of it to the debtor. Or he did not make a bequest, then if the heirs agree to allocate money from the inheritance for charitable purposes, it is permissible to disburse it to the debtor. It is also permissible to give to the poor debtor from zakat and sadaqah. The deceased's ownership of the money ceases immediately upon his death.
