What should a father do regarding his child who was stillborn in the sixth month of pregnancy?

1 min readAlso available in العربية

What your father did by burying the fetus without washing or praying over it has been stated by many scholars, such as the Malikis, who argue that a fetus should not be prayed over unless it cries out loudly upon birth. Whereas some scholars, such as the Hanbalis, went of the view that if a fetus reaches four months of gestation, it should be washed and prayed over, basing their argument on the hadith: "And the stillborn child is prayed over, and forgiveness and mercy are supplicated for its parents." In any case, there is nothing due from the one who did this now, except seeking forgiveness if they proceeded with it out of ignorance and without seeking a fatwa.
