Is it permissible for a wife to seek a Khul’ (divorce initiated by the wife) from her husband if he has abandoned her for more than six months and has not provided for her, knowing that their civil divorce case is pending before the court?

A husband is not permitted to abandon his wife or withhold financial support from her unless she is disobedient (nashiz), otherwise he is sinful. The wife has the right to present her case to a Sharia judge or a trustworthy Islamic center if she is in a non-Muslim country. It is permissible to resort to non-Muslim courts out of extreme necessity to remove injustice from her. The wife has the right to seek divorce upon proving harm, or khul' (divorce at the wife's instance with compensation) based on what they agree upon.
