If a husband swears by Allah to divorce his wife, and his mother prevents him, and he obeys her, then an expiation for a broken oath (kaffarat yamin) is incumbent upon him. However, if he swears by divorce to divorce her, then the divorce, according to the preponderant opinion of scholars, takes effect in all cases, whether he divorces her or not, because swearing by divorce has the ruling of conditional divorce according to the majority of scholars. Anger does not prevent the occurrence of divorce unless the one swearing reaches a state where he cannot control himself, nor distinguish what he says or does.
