The soul of a believer is tied to his debt until it is paid off for him, meaning that his matter is suspended, with no judgment of salvation or perdition. This is supported by what Al-Bukhari narrated, that the Prophet (peace be upon him) refrained from praying over a deceased person who owed a debt until Abu Qatadah undertook to pay it off. It is obligatory for the heirs of the deceased to pay off his debt from his estate before distributing it, because the debt is a right for the creditors, and the Holy Quran has clarified that the inheritance is not distributed except after paying off debts and executing the will, and debt takes precedence over the will. If the deceased's estate is insufficient to cover his debt, the heirs may pay the remaining amount from their own money. As for unknown creditors, efforts should be made to find them, and if they cannot be identified, their right should be given in charity on behalf of the deceased.
