What should the guardian do if some heirs wish to terminate the guardianship and assume responsibility for the inheritance, while other heirs remain minors in need of guardianship?

Guardianship is valid over those who are legally incapacitated, such as children, the insane, and the imprudent. As for mature, sane adults, no one has the right to place them under interdiction. The guardian may dismiss himself during the lifetime of the testator and after his death. This is the view held by Ash-Shafi'i, whereas Abu Hanifa believes it is not permissible after death.
