Is it obligatory for someone who erred in entering into a state of Ihram from Jeddah instead of the plane, based on a previous fatwa, to offer a compensatory sacrifice (dam kaffarah) in their subsequent Hajj, or does the previous fatwa exempt them from responsibility?

The majority of scholars hold that Jeddah is not a Miqat (definition) and it is not permissible to delay the state of ihram (definition) until reaching it, except for those coming from Suakin. For them, it is permissible to assume ihram from Jeddah due to its distance of two stages from Mecca. Ibn Hajar al-Haytami mentioned that whoever does not pass by a Miqat should assume ihram from a distance of two stages from Mecca, giving the example of someone coming from Suakin to Jeddah before passing by Rabigh or Yalamlam. For someone who assumes ihram from Jeddah and is not from the people of Suakin, there is no harm upon him if he follows the opinion of one of these scholars. However, it is better to slaughter a sheep in Mecca for the poor of the Haram (definition) to resolve the dispute.
