Is it permissible to donate with the intention of absolving oneself from old rights that could not be returned to their owners, such as picking fruit from houses whose owners are unknown?
We fear that the question may stem from obsessive thoughts (waswasah) or blameworthy over-scrupulousness (takalluf madhmum). Customarily, people are lenient regarding the consumption of fruits from trees in homes and gardens, and there is a legal concession ( shar'iyyah) for this, with its specific conditions. As long as it is difficult to reach the owners of these fruits, the questioner should not delve too deeply into the matter. It suffices for her to donate or give charity on their behalf with the intention of clearing her conscience and safeguarding her faith, but without excessive burdening of herself or making things difficult for herself.
