A son who dies before his father does not inherit from him. Similarly, grandchildren do not inherit from their grandfather if he has direct living children, due to the condition that the heir must be alive after the deceased. Therefore, your brother's children have no right to their grandfather's house, as they are excluded from inheritance by the presence of the sons. However, it is recommended that the paternal uncles give them something from the inheritance, preferably an amount equivalent to what their father would have inherited had he been alive, in accordance with the Almighty's saying: "And when [other] relatives and orphans and the needy are present at the time of division, then provide them [something] from it and speak to them words of appropriate kindness." Inheritance cases must be brought before the Sharia courts for investigation.
