The maintenance of a needy mother is obligatorily incumbent upon her affluent children by consensus, and similarly, the maintenance of sisters is incumbent upon their affluent brothers. This maintenance is distributed among the affluent children according to their financial capacity, and not according to the number of individuals or the share of inheritance. A prerequisite for the obligation of maintenance is the poverty of the one being maintained, and the affluence of the one providing maintenance, meaning that they possess what exceeds their needs and the needs of those they support. The estimation of this matter is subject to the discretion of the judge.
