What is the ruling of Islamic law on continuing a marriage to a husband who: treats his wife cruelly, forced her to become pregnant twice despite the danger this posed to her health, expels her from the home, whom the wife suspects of engaging in aberrant acts with their daughter, does not pray, has no protective jealousy over his female kin (maharem), has gone so far as to speak of Christianity in a way that suggests his conversion, and threatened to publish private photos of her if she asks for a divorce and custody of the children?

If the husband does not pray, cannot be trusted with the children, and has Christian leanings, then we advise separating from him. Allah will compensate with someone better. The mother has a greater right to custody of the children as long as she does not remarry. If she remarries, custody transfers to their maternal grandmother. When the children reach the age of discretion, they are given a choice between the parents, unless the father is an immoral person who cannot be trusted with the children.
