The question

What is the ruling on a paper marriage—a temporary one—that is contracted for the purpose of studying abroad, where all the pillars of marriage are met (witnesses, guardian, notary public), but the husband does not consummate the marriage with his wife, nor does he live with her, and divorce may not even occur between them?

The answer

A marriage conditioned on subsequent divorce is void. However, a marriage entered into with the intention of divorce, without such a condition stipulated in the contract, is valid according to the majority of scholars. A marriage conditioned on an option (khiyar) is void. The wife's stipulation that her husband not consummate the marriage is void; this condition becomes null, but the contract itself remains valid, and the dower is an exclusive right of the woman.
