The decisive authority in dispute cases is the courts or their equivalent. The Sharia came to preserve people's rights and permit the taking of compensation for damages. As for compensation for moral damages, contemporary jurists have differed, some prohibiting it and others permitting it. The preponderant opinion is prohibition, unless the judge rules it without a request.
