Does the divorce initiated by the husband, while in a state of hysterical rage, take effect?
If a husband's anger reaches the point where he is unaware of what he is saying, his divorce does not count. However, if he is aware of what he is saying, the divorce is valid. Divorce is often uttered by a person in a state of anger. Al-Ruhaibani al-Hanbali said: "Divorce issued by one who is angry and whose intellect has not completely departed is valid, because he is held accountable for what he utters in a state of anger." This is the view of the majority of jurists, while some do not validate the divorce of an angry person if his anger is intense. We advise presenting the matter to trusted scholars or the Sharia court, and we caution against haste and anger, urging prudence and caution, and addressing anger through legitimate means such as seeking refuge with Allah and performing ablution.
