Is it permissible to take a beehive found in a tree on private land, and does the ruling differ if the land has a fence or if it is in an orchard or farm?

If bees nest on a piece of land, the owner of the land does not own them unless he has prepared a place for them. If he has not done so, then they are permissible for anyone who gets to them first to take them and their honey. However, it is forbidden to enter fenced land without permission. This is the view of the Hanbalis.

As for the Hanafis, they believe that the owner of the land owns the honey produced on his land, because it is considered part of the land's produce, whereas he does not own the bees themselves, and others may take them.
