It is not permissible to kill someone who climbs over houses but does not intend to assault property, lives, or honor. However, if he intends to commit assault, he is an aggressor (ṣāʾil) who should be repelled with the lightest means possible, then progressively more forceful ones. He should not be killed if it is possible to repel him with less than killing. Rather, it is obligatory to get rid of him by seeking help or fleeing if possible. Similarly, it is not permissible to kill an aggressor while he is fleeing.
