Divorce issued by one afflicted with obsessive-compulsive disorder (waswas) without their conscious choice is not effective. However, divorce issued while one is aware and acting out of their own choice is effective. It is permissible for the one afflicted with waswas to adopt the easiest of scholarly opinions to alleviate hardship and rid themselves of these obsessive thoughts, even though the general principle is that it is not permissible to act upon a fatwa whose correctness one is not confident in.
