A conditional oath of divorce made in a state of anger results in divorce as long as the angry person is aware of what he is saying. This is the fatwa given. Ibn Taymiyyah held the view that if one swears by divorce without intending to effect it, then expiation for an oath (kaffarat yamin) is required upon breaking it. However, if the oath of divorce was uttered in extreme anger that deprived the husband of his sanity, then his words are null and void, and neither divorce nor expiation results from them.
