Is picking flowers, fruits, or similar items from trees in the street or those overhanging from people's homes onto the street considered stealing?

It is permissible to cut flowers and pick fruits from trees on the road that are not owned by anyone, because a person may benefit from what is on the earth as long as it is not under the hand of a private owner. As for what is owned by someone, scholars have differed regarding the permissibility of eating from it. The apparent (ruling) is the permissibility of eating from another's garden wall after calling out to the owner three times without a response, provided that nothing is carried away from it.
