How can a sister recover her right to the ownership of the house that her husband built with a usurious loan from her salary, and which he refuses to share with her?
It is obligatory for the husband to spend on his wife and children in a reasonable manner. The wife's salary is her exclusive right, and she is not obliged to spend from it except as a voluntary act. If the wife spends from her money on her husband with the intention of repayment, she has the right to claim it. However, if it was done willingly without the intention of repayment, it is considered a gift that cannot be reclaimed. We advise the wife to discuss this with her husband, and if that does not work, she can refer the matter to the Sharia judge. It must be noted that a husband borrowing from a usurious bank is a grave sin. He should also be advised to repent from smoking and to stop staying out of the house unnecessarily.
