If the divorce is for compensation, it is a khulʿ by which the wife becomes irrevocably divorced with a minor irrevocability (baynūnah ṣughrā). If the spouses wish to return to each other, a new contract must be concluded. The khulʿ is not counted as a ṭalāq (repudiation); rather, the husband retains the remaining repudiations. This is the preponderant opinion, although it is advised to use the word “khālaʿa” (he performed khulʿ) instead of “ṭallaqa” (he repudiated) to avoid jurisprudential disagreement. As for a guardian refusing to marry a woman to a competent man whom she has accepted, this is ʿaḍl (undue prevention), and guardianship transfers to the next in line. The woman may refer the matter to a judge, and it is recommended for conciliators to intervene to resolve the issue and persuade the guardian to agree.
