Is it Islamically permissible to sell gold (bullion) if its price is paid via a bank transfer that takes one or more days to reach the seller’s account, knowing that this is the only method available to the company?
Selling gold for cash is permissible on condition of taqabud (mutual possession). This taqabud can be either physical or constructive. One form of constructive possession that is considered valid both religiously and customarily is a bank credit for a sum of money in the customer's account, whether deposited directly or via a bank transfer. A delay in the bank credit is excused, provided the beneficiary can effect actual receipt within the commonly known periods in financial markets, and provided the beneficiary does not dispose of the currency during this excused period until actual receipt becomes possible. Thus, constructive taqabud is achieved in the aforementioned scenario as long as the company pays the required amount to the seller through a direct bank transfer from its account to the seller's account.
