If the money was earned through unlawful means, and its owner was aware of its prohibition, then it is ill-gotten gain that may not be used. However, if its owner is poor and in need, then it is permissible for him to take from it only what suffices his need. He may also give it as charity to himself and his dependents if they are poor. Some scholars hold that if the owner of this money repents and is poor, it is permissible to give him from it an amount sufficient for his need or as starting capital for him.
