What is the ruling on the oath sworn by the brother not to go to his wife's family or to take them there, knowing that he died on his way to them and had not yet reached them?

The jurists differed concerning someone who swore not to go to a certain place and then set out for it but did not reach it. Some said he breaks his oath by setting out for it, even if he does not reach it. Others said he does not break his oath until he reaches it. We believe that the more accurate view is that he does not break his oath as long as he has not reached it, based on the Almighty's saying: {Go to Pharaoh}. The intention behind "going" is reaching. If they had not reached him, they would not have obeyed the command. Therefore, your brother is not obligated to offer expiation for the oath, especially since his intention was to reach and deliver them. However, giving out the expiation from his estate or from the wealth of one of you is more cautious and clears his conscience.
