Is it permissible for a wife to leave her husband's house for her family's house without his consent, due to severe humiliation or repeated beating that does not adhere to Islamic guidelines, and does she have the right to seek a divorce for this harm?
The fundamental principle is that a husband should treat his wife kindly, without causing physical or emotional harm. If she displays defiance, he should treat her by admonition, then by abandonment in bed, then by non-severe striking. It is absolutely not permissible for him to insult, revile, or degrade her.
And the fundamental principle is that a wife is not permitted to leave her husband's house or seek divorce except for a legitimate religious reason. She is permitted to seek divorce if the husband does not treat her kindly and her remaining with him would cause harm and hardship. As for leaving the house, it is not permissible except in cases where she fears for her safety, or to seek help from someone who can avert harm from her, or in special circumstances such as fearing for her safety or her property, or her need for a judge to demand her rights, or for seeking knowledge and religious verdicts if her reliable husband cannot suffice her.
