If you conditioned your wife's divorce on her leaving without your permission, and you intended to inform her of this, but she did not know or forgot, then the preponderant opinion is that the divorce does not occur. However, if you did not intend to inform her, or you did not believe her claim of not knowing, then the divorce occurs upon her leaving. But if you have intercourse with her during the iddah (waiting period), she has returned to your marital bond. It is obligatory for the wife to obey her husband and not to leave without his permission. It should be noted that swearing by divorce is one of the oaths of the dissolute and can lead to serious consequences.
