What is the ruling on one who swore an oath of divorce upon his wife that she not leave the house without his knowledge, and the wife left, then confessed to it, having denied her knowledge of the oath, and marital life continued between them?
If you conditioned your wife's divorce on her leaving without your permission, and you intended to inform her of this, but she did not know or forgot, then the preponderant opinion is that the divorce does not occur. However, if you did not intend to inform her, or you did not believe her claim of not knowing, then the divorce occurs upon her leaving. But if you have intercourse with her during the (waiting period), she has returned to your marital bond. It is obligatory for the wife to obey her husband and not to leave without his permission. It should be noted that swearing by divorce is one of the oaths of the dissolute and can lead to serious consequences.
