Is the husband sinful, in Islamic law, for preventing his wife's mother from entering his home? And is the wife sinful for accepting this condition? And is it permissible for the wife's family to treat her similarly and deprive her of her rightful inheritance?
Marriage in Islam is a union between two families or tribes. The Quran alluded to this by saying: ﴿And it is He who created from water a human being and made him [a relative by] lineage and marriage.﴾ The husband's condition that his wife not permit her parents to visit her in his home contradicts the objectives of Islamic law and leads to the severing of kinship ties and corruption of relations. Scholars have explicitly stated that it is not permissible for the husband to prevent the wife's parents from visiting her, unless there is a strong suspicion of harm based on circumstantial evidence. In such a case, he is permitted to prevent it to avert harm. Therefore, the condition of prevention is null and void, and the wife is not obligated to fulfill it unless harm occurs. Maintaining kinship ties is obligatory and is not nullified by the other party severing them. The Prophet, peace and blessings be upon him, said: "The one who maintains kinship ties is not the one who reciprocates, but the one who maintains kinship ties is he who, when his relatives cut him off, he connects with them." A woman has the right to inheritance, and the severing of her kinship ties does not nullify it.
