Marriage is not validated by merely reciting the Fatiha. For a marriage contract to be valid, it requires an offer and acceptance, a guardian (wali), and two witnesses. The majority of scholars stipulate that the two witnesses must be males, and the sister of the wife cannot be a witness. Scholars have differed regarding the validity of the testimony of the husband's father or son; some consider it invalid, while others deem it valid, and this latter view is the one acted upon. The brother can be a witness. If the contract is valid, the husband is permitted to be in seclusion with his wife and go out with her, and he has all the rights of a husband. However, it is preferable not to engage in sexual intercourse until the marriage is publicly announced.
