The question

Is it permissible for a woman to seek divorce from her husband if he wishes to marry another, and she is intensely jealous and unable to fulfill his rights, and he does not respect her feelings, and there are no kind words or courtesies exchanged between them, and she does not feel happy, and he might even openly express his lack of desire for her?

The answer

A husband should fear Allah regarding his wife and not hurt her feelings with harsh words, for wives have rights just as they have duties, in accordance with what is good and reasonable. A wife's request for divorce due to her husband's desire for polygyny is impermissible, based on the Almighty's saying: "then marry those that please you of [other] women, two or three or four," and the Prophet's (peace be upon him) saying: "Any woman who asks her husband for divorce without any strong reason, the scent of Paradise will be forbidden to her." The husband is advised to refrain from hurting his wife by explicitly stating his disinterest in her, for the Almighty says: "And if you dislike them – perhaps you dislike a thing and Allah makes therein much good," and the Prophet (peace be upon him) said: "A believing man should not hate a believing woman; if he dislikes one of her characteristics, he will be pleased with another." So, it is either retaining her with kindness or releasing her with grace.
