Partnership is permissible in Islam and established by the Qur’an, Sunnah, and scholarly consensus (Ijma’). It is of two types: partnership in ownership (shirkat amlak) and partnership in contracts (shirkat ‘uqud), which includes: shirkat al-‘inan, shirkat al-abdan, shirkat al-wujuh, shirkat al-mudarabah, and shirkat al-mufawadah. A condition for its validity is that the contracting party must be legally competent to dispose of property, because it is a contract involving the disposition of wealth. Partnership has detailed conditions, pillars, and rulings elaborated in books of Islamic jurisprudence.
