Is it permissible for someone whom a doctor has informed of their impending death (within one or two years) to give charity from their wealth without consulting their family?

Whoever is afflicted with a commonly feared illness, or if a doctor has informed him of such, is not permitted to dispose of his wealth except within the limits of one-third, unless the heirs permit more than one-third. Imam Malik said: "If the illness is feared, its owner is not permitted to dispose of anything except within his one-third." Therefore, this person may donate one-third of his wealth in charity, and anything exceeding one-third depends on the permission of his heirs, and he should consult them regarding it.
