Does a divorce take effect if one says, "Divorce is obligatory upon me," without intending it, given that he is afflicted with obsessive thoughts of divorce?

1 min readAlso available in العربية

A person afflicted with obsessive-compulsive disorder (OCD) is not bound by a divorce (talaq), even if he utters the explicit word, unless he truly intends and wills it in a state of tranquility and mental stability. This is because he is overwhelmed by his condition. His divorce is not binding based on the Prophet Muhammad’s (peace be upon him) saying: "There is no divorce in a state of compulsion (ighlaq)."

Mere thoughts of divorce do not necessitate anything, and divorce does not occur simply by the word coming to mind. We advise turning away from these obsessions and not paying attention to them.
