I swore to my wife and said, "By Allah, we will never again be under one roof"?

1 min readAlso available in العربية

A man's statement to his wife, "We will never be under one roof," is a metaphorical divorce (kinayah talāq). If he intended divorce by it, then it counts as such; otherwise, nothing is incumbent upon him. If divorce occurs, he may reconcile with his wife before her waiting period (iddah) ends, provided this divorce does not complete the three divorces. The waiting period of a divorced woman ends with purification from the third menstrual cycle, or by giving birth if she is pregnant, or by the passage of three months if she does not menstruate. If he cohabits with his wife under one roof after uttering this metaphor, an expiation for breaking an oath (kaffārat yamīn) becomes binding upon him for his transgression.
