If the driver takes all safety precautions and is unable to avoid an accident, he is not considered responsible for the damages, and his companion has no right to claim compensation. However, if the driver neglects any of the preventive measures, such as speeding or failing to inspect the car, then he is responsible, and his companion has the right to claim compensation. The driver is obligated to pay it unless the responsibility is transferred to another party that agrees to it.
