There is Sharia evidence indicating the permissibility of social solidarity and cooperation among Muslims, and that the poor have a right to the public treasury (Bayt al-Mal). This includes the pension system, which involves disbursing monthly stipends to the poor and needy from the public treasury, as well as to employees upon reaching a certain age or upon their death, through the deduction of a portion of their salaries, to which a portion paid by the employer is added, and the total amount is paid to the employee or their heirs. Among the Sharia evidences for this are the words of Allah Almighty: "And know that whatever you gain of war booty, then indeed, for Allah is one fifth of it and for the Messenger and for [his] near relatives and the orphans, the needy, and the traveler" (Al-Anfal: 41), and His words, "Whatever Allah has returned to His Messenger from the people of the towns – it is for Allah and for the Messenger and for [his] near relatives and the orphans, the needy, and the traveler" (Al-Hashr: 7), and His words, "And cooperate in righteousness and piety" (Al-Ma'idah: 2). Also, the two Sheikhs (Bukhari and Muslim) narrated from the Prophet, peace and blessings be upon him, in the hadith of the Ash'aris, and the saying of Umar ibn al-Khattab, may Allah be pleased with him. However, the practical application of the pension system may involve Sharia violations, such as investing funds in usurious banks or commercial insurance.
