Is it permissible for the marriage or the contract to take place inside the mosque?

The majority of jurists recommend performing the marriage contract (Nikah) in the mosque for blessings and publicity, citing the hadith: "Announce this marriage, perform it in mosques, and beat drums for it." This hadith is weak. The correct view is that performing the marriage contract in the mosque is permissible in principle, especially if there is no other suitable place, or if it helps avoid wrongdoing. However, consistently performing the marriage contract in the mosque for every contract, or believing that it has a special virtue, is an innovation (bid'ah). If the contract in the mosque is accompanied by mixing of genders (ikhtilat) or musical instruments (ma'azif), then performing it in the mosque becomes even more forbidden. The permissibility of the contract in the mosque in principle is supported by the hadith of the woman who offered herself to the Prophet, peace be upon him, and he married her to one of his companions in the mosque. It is not from the Sunnah to perform the marriage contract in the mosque, and persistently doing so is an innovation. The Permanent Committee (for Islamic Research and Fatawa) has stated that the matter is broad, and that adhering to performing the contract in the mosque is an innovation, and that Sheikh Ibn Uthaymeen did not know of any evidence for its recommendation.
