Is it obligatory for the questioner to retake the General Secondary Examinations next year to achieve a GPA higher than 80%, based on her father's divorce oath: "Divorce upon your mother, otherwise you will become like my sisters if you get less than 80, you will not enter university"?

In this issue, divorce and the implicit word for ẓihār (a form of divorce by injurious assimilation) are combined in a single utterance. The preponderant view in this matter is to consider it a divorce, meaning ẓihār does not occur, as stated in Rawḍat al-Ṭālibīn. The father's oath by divorce is subject to the ruling of conditional divorce according to the majority of scholars; thus, the divorce occurs upon the occurrence of the condition it was made dependent upon. If the divorce does not occur, then an expiation is due.

Accordingly, you are not permitted to enter the university as long as you have not achieved the required total score. If you do so, a divorce will fall upon your mother. You may repeat the year to achieve the required total score, unless the father intended to restrict the oath specifically to this year. In matters of oaths, one refers to the intention of the one who swore the oath; if he intended something that his oath could bear, then his oath would be directed towards that intention.

It is advisable to consult a Sharia court or knowledgeable scholars to ascertain the father's intention and purpose, and to follow whatever fatwa is issued.
