What is the ruling on someone who fondled his wife during the day in Ramadan, leading to both of them ejaculating, and then had intercourse with her on the same day several hours later, knowing that he did not intend intercourse by the fondling?

What this person did—fondling his wife and enjoying her during the day in Ramadan until both ejaculated, then having intercourse with her afterwards—is a forbidden act and a major sin. He must repent for it. He is also required to offer expiation (kaffarah) for intercourse, and the invalidation of his fast before it does not absolve him of this. The expiation for intercourse is: freeing a slave. If he cannot find one, then fasting for two consecutive months. If he is unable to do that, then feeding sixty poor people.
