Is it permissible for me to take a false oath – considered an oath of immersion (yamin ghamus) – to reclaim my rights from my ex-husband who forged documents to dissipate my movable property?

Lying is forbidden (haram), and the most heinous type of lying is the 'al-yamin al-ghamus' (the immersing oath), which is a major sin (kabira). Lying is permissible in an oath to repel injustice and harm from oneself, provided that there is no other means, and that one resorts to circumlocution (ta'rid) as much as possible. The best approach is piety (wara'), but if one takes the allowance (rukhsa), then the husband's rights must be preserved, and only what is due to him should be taken. Injustice (dhulm) and oppression (baghi) combine with al-yamin al-ghamus and injustice, and these are sins whose punishment is hastened.
