The majority of scholars hold that a shared employee [ajir mushtarak] is liable for what his hand damages, whether he was negligent or not. The worker in the shop is a shared employee who guarantees what he damages. Therefore, it is permissible for the owner of the damaged item to take a similar item or its value.
