It is not permissible for someone who sees a person committing adultery with his relative or another woman to kill him, for three reasons: First, not all adulterers deserve to be killed. Second, the hudud punishment for adultery is not established except by confession or by the testimony of four witnesses. Third, the implementation of hudud punishments is the right of the ruler, not individuals, because that would cause chaos and corruption.

An exception to this is if a husband finds his wife committing adultery and kills her or both of them, and the adulterer was muhsan (married), then he bears no sin in what is between him and Allah. Regarding the obligation of qisas (retribution) upon him, there is a difference of opinion among scholars.
