What is the interpretation of the Hadith: "Whoever buys a ewe that has its udder tied [to make it appear full of milk] should return it along with a Saa' of dates," and where can this interpretation be found?
The agreed-upon narrated by Abu Hurairah is: "Whoever buys a musarrah sheep should take it back and milk it. If he is pleased with its milk, he keeps it; otherwise, he returns it along with a sa' of dates."
Tashriyah means tying the udders of a sheep to prevent it from being milked and to accumulate milk, making it appear more productive. This is forbidden because it is deception and fraud in everything, whether it be a camel, cow, sheep, female slave, or horse. The sale with tashriyah is valid, but the buyer has the option to keep or return it. The Hadith indicates the prohibition of tadlis (deception) in everything, and that a sale involving it is valid, and deception through action is forbidden, just as deception through speech is forbidden.
